Wilder Places Marketplace Terms of Service

Dear users of WilderPlaces.com, Please take the time to carefully read through our Marketplace Terms of Service (ToS). The following provisions, insofar as validly agreed upon, will form the basis of the (marketplace)agreement between you and Rewilding Europe B.V., hereinafter referred to as “Wilder Places.”

1. Application

1.1 These Terms of Service ("ToS") apply to your use of the online marketplace www.wilderplaces.com ("Wilder Places Marketplace"). The marketplace is operated by:

From here on, we’ll refer to this operator simply as "Wilder Places."

1.2 By using the Wilder Places marketplace, you agree to these ToS. Any different terms or conditions from your side don’t apply - even if we don’t specifically reject them.

2. Users

2.1 You must be at least 18 years old and legally capable to use the Wilder Places marketplace.

2.2 There are two types of users on Wilder Places:

  • Customers – people who want to book a rewilding stay, experience, multiday tour, or other nature-based activity.
  • Providers – organizations that offer these nature-positive experiences and services.

2.3 Providers must be organizations that actively support rewilding or have a positive impact on nature and ecology. Before they can register, Wilder Places will assess whether the organization fits this description. We may ask for supporting documentation as proof.

2.4 Both Customers and Providers can be individuals (consumers) or businesses (entrepreneurs).

  • A consumer is someone booking for mostly personal, non-commercial reasons.
  • An entrepreneur is someone acting in a professional or commercial capacity.

3. Registration on the Wilder Places Marketplace

3.1 For Customers

  • 3.1.1 To book through Wilder Places, you need to register by filling in the required info. Registration is not automatic - Wilder Places may reject or delete any registration without explanation.
  • 3.1.2 You’ll need to provide your email address and choose a password. Once your registration is approved, you can log in.
  • 3.1.3 Wilder Places may verify your data and, if needed, revoke access - again, without needing to give a reason.

3.2 For Providers

  • 3.2.1 Providers must also register before listing anything. As with Customers, Wilder Places can decline registrations without giving a reason.
  • 3.2.2 After registration info is submitted, we check for completeness and accuracy. If all looks good, we’ll activate your account.
  • 3.2.3 All Providers agree to follow the Provider Criteria and Rewilding Tourism Principles as detailed on the “How to become a provider” page and in Appendix A of these ToS.
  • 3.2.4 If you’re an outbound tour operator, you’ll first need to sign a partnership agreement with us. Once that’s done and we’ve confirmed your eligibility as a ‘nature positive tour operator,’ you’ll receive an invitation to join the marketplace.
  • 3.2.5 During registration, Providers also need to submit an email and password. Once approved, they can use these to access their account.

4. What Wilder Places Offers

4.1 Wilder Places gives Providers a marketplace to list and showcase their nature-positive offerings - such as stays, experiences, or tours - so Customers can find and book them.

4.2 Wilder Places itself doesn’t offer or manage these services. We just run the marketplace and are not responsible for, nor in any way liable in respect of, these services. The Providers are fully responsible for the services they offer, including how they deliver them.

4.3 All bookings are direct agreements between the Provider and the Customer. This means the Provider’s own terms, including cancellation and liability policies, apply to the booking.

4.4 Customers may be able to leave reviews about their experience with the Provider - this is what we call “Customer Content.”

5. Service on Wilder Places

5.1 What Providers are responsible for

  • 5.1.1 If you’re a Provider, you’re fully responsible for your listings and the services you offer. This means that as a Provider you ensure that you comply with all required (local, national and EU) regulations around (properly) offering, informing about, and (correctly) performing the services you offer. You need to keep your listing info accurate and up to date (like location, availability, and description).
  • 5.1.2 We may allow you to upload content (like text, photos, videos, etc.) related to your offers.
  • 5.1.3 Everything you post should be correct and current. Please update us if anything changes. Also, make sure your customer experience runs smoothly - from booking to payment. If Customers are paying you for a nature-based experience, use that money as intended - for nature-positive impact.
  • 5.1.4 When you get a booking request, you must let us know within 72 hours whether you can host the guest and want to confirm the booking. Confirming means you agree to the booking under the stated terms.

5.2 What Customers are responsible for

  • 5.2.1 Be respectful - towards the Provider, their staff, and nature. Follow any rules they set.
  • 5.2.2 If you leave a review, keep it honest, factual, and respectful.

5.3 What both Providers and Customers are responsible for

  • 5.3.1 Everyone must follow the law and avoid actions that:
    • Harm nature
    • Harm others physically or mentally
    • Offend, harass, or disrespect others
    • Infringe on property, privacy, or intellectual rights\
  • 5.3.2 You’re responsible for keeping your account safe. If you think someone else has access, let us know right away.

6. Booking an offer & How contracts are formed

6.1 Wilder Places helps Customers book offers listed by Providers on our marketplace.

6.2 We charge the Customer a service fee for the use of our marketplace when a booking is successfully made. This fee is not refundable if you later cancel.

6.3 How the booking process works

  • 6.3.1 To book, choose an offer and provide info like dates and group size, then click a booking button (like "Request to Book").
  • 6.3.2 You’ll be asked to confirm some details and agree to pay our service fee (between 5–10% of the full booking price). After that, you’ll be redirected to Stripe to pay the fee. Once you’ve done that, your request is sent to the Provider. This is a binding booking request.
  • 6.3.3 We’ll email you a confirmation that your request was received. This is not yet a booking confirmation.
  • 6.3.4 Within 72 hours, we’ll let you know if the Provider has accepted. If they do, we’ll send you the booking details in a capacity confirmation.
  • 6.3.5 Once confirmed, the service fee will be charged from your chosen payment method.
  • 6.3.6 We’ll then send both you and the Provider a final booking confirmation.
  • 6.3.7 If the Provider cancels after confirming, we’ll refund your service fee within 5 working days. If you cancel, the service fee is non-refundable.

6.4 The booking is a direct agreement between Customer and Provider. Wilder Places is not a part of that contract. We are not responsible for, nor in any way liable in respect of, the booked services. The Providers are fully responsible to the Customer for the services they offer, including how they deliver them. Complaints by the Customer about the services should be addressed exclusively to the Provider.

6.5 We don’t handle the payment between Customer and Provider. How and when payment happens is agreed upon between the two of you. Also every other follow up contacts about the (execution of the) services will take place directly between Customer and Provider.

6.6 The contract language for using Wilder Places is English.

7. Using the Wilder Places Marketplace

7.1 You can use the Wilder Places marketplace and its features as outlined in these Terms of Service.

7.2 You’re responsible for making sure you’ve got the tech you need (e.g. internet, device) to use our marketplace. We can’t help with setup or troubleshooting for that.

7.3 Unless we specifically say otherwise (like providing a download button), you can only use the content and functions we offer within the limits described here.

8. Rights of Use

8.1 Rights for Providers to Use Content

  • 8.1.1 Providers can post content on the Wilder Places marketplace, making it available to customers, according to the rules in Sections 5 and 7.
  • 8.1.2 By posting content, Providers give Wilder Places a free, transferable right to:
    • Store and display the content on the marketplace.
    • Modify and reproduce the content as needed for publication.
    • Promote the content on social media to help Wilder Places grow.
    • Allow other users to use the content as per Section 8.2.
  • 8.1.3 If a Provider removes content from the marketplace, Wilder Places’ rights to use that content end, except for social media promotion (as described in 8.1.2.c). However, copies made for backup or verification may still be kept. Rights granted to other users remain unaffected.
  • 8.1.4 Providers are fully responsible for the content they post. Wilder Places does not check it for accuracy or legality unless required by law.
  • 8.1.5 Providers guarantee that they own the content or have permission to post it and grant the rights described in 8.1.2.
  • 8.1.6 Wilder Places may refuse, edit, or remove content if it violates terms or if there’s a risk of violation, considering the Provider’s interests and using the mildest approach to prevent violations.

8.2 Rights for Users to Use Content

  • 8.2.1Wilder Places gives users the right to use the marketplace and its content for personal use, as long as they follow these terms.

8.3 If users can download or print content, they receive a non-exclusive, unlimited right to use the content for personal, non-commercial purposes.

8.4 Legal rights, such as personal use or copying, are still valid.

9. Marketplace Availability

9.1 The Wilder Places marketplace is available 24/7. Wilder Places guarantees 95% availability per year, excluding regular maintenance, which is done to minimize disruptions.

10. Liability

10.1 Users’ Liability

  • 10.1.1 Users are liable for any damage they cause to Wilder Places according to the law, except where stated otherwise.
  • 10.1.2 If a user violates these Terms of Service in any way and that leads to claims from third parties (including other users), the user will indemnify Wilder Places against those claims and fully compensate Wilder Places in that respect.

10.2 Wilder Places’ Liability

10.3 Wilder Places is to the extend permitted by law, only liable for damages in cases of intentional actions or gross negligence by its representatives, employees, or agents. In other cases Wilder Places’ liability is excluded. Should Wilder Places despite the foregoing still be held liable in a court of law, on any grounds whatsoever, Wilder Places' liability is limited to direct damages ánd moreover to a maximum amount of €1.000,-. Any liability for indirect damage and consequential damage (such as but not limited to loss of turnover or revenue, lost profits, missed savings, loss of data, loss of goodwill, or damage due to business interruption) is expressly excluded.

11. Data protection

Wilder Places processes users' personal data in accordance with the GDPR. For more details, check the Privacy Policy: Privacy Policy of Wilder Places.

12. Consumer dispute resolution

12.1 Consumers can use the European Commission’s marketplace for online dispute resolution at: http://ec.europa.eu/consumers/odr/.

12.2 Wilder Places' contact email is hello@wilderplaces.com.

12.3 Wilder Places does not participate in consumer arbitration proceedings and is not obligated to do so.

13. Ranking

Providers’ offers are listed by the date posted, with the most recent at the top. Customers can filter results (e.g., by country, price, etc.). Wilder Places may highlight Featured Listings, and can reorder or remove them without explanation.

14. Term and termination

14.1 Both Customers and Providers can delete their accounts and end the marketplace agreement at any time.

14.2 Wilder Places can terminate the user agreement with 2 months' notice. If contracts between Customers and Providers for rewilding experiences are still active, these terms continue to apply until they are completed.

14.3 Either party (user or Wilder Places) can terminate the agreement immediately for good cause.

15. Governing law and jurisdiction

15.1 These terms and any conflict in respect of the use of the Wilder Places marketplace are governed by Dutch law, excluding international uniform law, unless mandatory consumer protection laws apply.

15.2 If the user is a business or public law entity, legal disputes will be handled exclusively by the Dutch court where Wilder Places is based. If the user is a consumer, disputes will be handled by the Dutch court of the user’s residence. The user has the right however to choose the Dutch court where Wilder Places is based.  

Appendix A: Provider criteria & Rewilding tourism principles

Provider criteria

General

  • Commitment to sustainability: the provider should have a recognized sustainability commitment (e.g., GSTC certification, B Corp, Long Run membership) or demonstrate clear sustainable business practices.
  • Positive customer feedback: if you receive customer reviews, we require a minimal rating of 4.0 on Google or other verified customer feedback demonstrating positive traveler experiences.
  • Nature-positive positioning: the business should actively promote nature-positive values and conservation in its branding, marketing, and operations.

Specifics for tour operators and DMCs:

  • Registered legal entity: the partner must be a legally registered business or organization.
  • Basic English proficiency: at least one team member must be able to communicate in basic English to facilitate international tourism.
  • Relevant experience in nature-based tourism: must have a proven track record of operating nature-focused experiences, ideally aligned with rewilding principles or similar conservation tourism concepts.

Rewilding tourism principles

  • Commitment to rewilding tourism values: providers must sign a pledge to adhere to the principles of rewilding tourism, ensuring that their activities contribute positively to nature and communities.
  • Support local economies: providers should collaborate with local businesses (e.g., accommodations, guides, transport, food services) to generate economic benefits within rewilding landscapes.
  • Financial contribution to rewilding: we charge a percentage of each booking to support rewilding efforts in the landscapes where they operate.
  • Mutual branding & promotion: agree to use and respect Rewilding Europe’s brand guidelines and engage in joint promotional efforts where relevant.
  • Fair compensation for local teams: any engagement with Rewilding Europe staff or local community members (e.g., as advisors, speakers, or guides) should be fairly compensated.
  • Local employment & capacity building: where possible, employ local guides and businesses, helping build local expertise and ensuring that benefits stay within the community.
